2. Scope of this Privacy Notice

This Privacy Notice applies to personal information collected through the Akiva website, contact or demonstration request forms, and communications related to our solutions, particularly with respect to visitors and users located in the United States and Mexico.

This Notice addresses information processing associated with the corporate website and Akiva’s informational or commercial communications.

It does not, by itself, describe every processing activity that may take place within specific Akiva products, platforms, or implementations. Such processing may be subject to additional privacy notices, agreements, contracts, or terms where applicable.

5. Google Analytics and browsing information

Akiva uses or may use Google Analytics to understand in general terms how visitors use the website.

Google processes this information as a technology provider in accordance with its applicable terms, policies, and the configuration implemented by Akiva.

Akiva uses this information for measurement, security, analysis, and improvement of the website and does not use Google Analytics for the purpose of collecting medical or clinical information.

Certain Akiva solutions have been designed for use by children in appropriate settings and under the supervision of adults, institutions, professionals, parents, or guardians, as applicable.

However, Akiva's corporate website and its demonstration request forms are intended for adults, including representatives of public or private institutions, professionals, parents, and guardians.

Akiva does not seek to collect personal information directly from children through these corporate website forms.

If we become aware that personal information relating to a child has been submitted directly through the website without the authorization required by applicable law, we may take reasonable steps to delete or restrict such information.

8. Technology providers and disclosures

Akiva does not sell personal information collected through the demonstration request form.

Information submitted through the form is currently used to receive and respond to requests by email.

To operate and measure the website, Akiva may use technology service providers that process information on Akiva's behalf, including infrastructure, email, and analytics services such as Google Analytics.

Such providers may process information only to the extent necessary to provide their services and subject to applicable contracts, configurations, and legal requirements.

Akiva does not intend to disclose personal information to independent third parties for their own commercial purposes unless consent has been obtained, a legal obligation applies, or another basis permitted by applicable law exists.

Akiva implements reasonable administrative, technical, and organizational measures designed to protect personal information against loss, alteration, destruction, unauthorized access, use, or processing.

Where Mexican law applies, Akiva will communicate its determination within a maximum of 20 business days from receipt of a complete request. If the request is granted, the corresponding action will be carried out within the 15 business days following that determination, subject to extensions and exceptions permitted by applicable law.

Where AKIVA SYSTEMS, INC. is subject to applicable provisions of the California Consumer Privacy Act (“CCPA”), as amended by the California Privacy Rights Act (“CPRA”), California residents may have certain rights regarding their personal information, subject to applicable requirements, exceptions, and limitations.
