Certain information related to purchases, invoices, payments, contracts, or licenses may be subject to legal or contractual retention requirements.
In such cases, Akiva will assess whether the relevant records should be deleted, blocked, restricted, or retained for the legally required period.
3. How to Request Deletion of Your Data
You can submit a data deletion request directly by email. You do not need to sign in to an account, install an application, or use any technical tools.

4. What Happens After You Submit a Request?
Requests will be handled through a process designed to review and verify the relevant records and determine which actions are appropriate.
Request Received
Akiva receives your email at sm@akiva.ai. As a proposed service standard, Akiva aims to acknowledge receipt within two business days.
Identity Verification
When necessary, Akiva may verify your identity or legal authority to help protect personal information against unauthorized deletion requests.
Information Identification
Authorized personnel will identify the relevant records in systems managed by Akiva.
Review and Deletion
Akiva will determine which information may be deleted and which records must be retained, blocked, or restricted under applicable obligations. Where appropriate, deletion will be managed in systems under Akiva's control.
Response and Confirmation
Akiva will communicate its determination and, when applicable, confirm the actions taken within the deadlines established by applicable law.
Response Timeframes
For requests governed by applicable Mexican personal data protection law, the general deadline to communicate a determination regarding an ARCO rights request is up to 20 days from receipt.
If the request is approved, the corresponding action must generally be implemented within the following 15 days, subject to applicable extensions, requirements, and legal exceptions.
Requests governed by other jurisdictions will be handled according to the deadlines and procedures required by the applicable law.
5. Data Retention and Deletion Periods
In addition to responding to individual requests, Akiva establishes retention periods intended to limit how long personal information remains in its systems.
| Information Category | Retention Period |
|---|---|
| Routine WhatsApp and Akiva AI Assistant conversations in Akiva-managed systems | Up to 180 days after the last interaction, unless justified exceptions apply. |
| Conversations associated with escalated support cases or service incidents | Up to 12 months after the case is closed, when reasonably necessary. |
| Backup copies managed by Akiva | Scheduled expiration or overwriting within 30 days after deletion from active systems, subject to legal exceptions. |
| Purchases, payments, invoices, and licenses | For the periods necessary to comply with legal, tax, accounting, and contractual obligations. |
The periods above concern records managed by Akiva. Technology providers may retain certain records under their own terms, technical configurations, and legal obligations.
6. Scope and Limitations of Data Deletion
When a deletion request is legally valid, Akiva will manage the deletion or appropriate restriction of relevant records under its control.
Conversations Stored in Google Cloud
Akiva may manage the deletion of conversation records stored within its Google Cloud infrastructure, according to the capabilities and configurations of the services used.
WhatsApp Conversations
Akiva may manage conversation records accessible and administered through its business WhatsApp environment, within the available technical capabilities.
Deleting records from Akiva's systems does not necessarily remove messages from a user's own WhatsApp account or personal device.
Processing Through OpenAI
Akiva AI Assistant uses OpenAI technology to process inquiries.
Any data or records retained by OpenAI services are subject to the integration used, its technical configuration, applicable contractual terms, and relevant policies.
Deleting a conversation from Akiva's systems does not, by itself, guarantee immediate deletion of all records independently managed by technology providers.
Legal Exceptions
Certain information may need to be retained for tax, accounting, contractual, security, fraud prevention, or legal proceeding requirements.
When complete deletion is not legally permitted, Akiva will inform the requester of its determination and relevant limitations, to the extent allowed by applicable law.
Deleting personal information does not necessarily cancel a purchase, entitle a customer to a refund, terminate a license, or remove existing contractual obligations.
Such matters are handled according to the applicable service terms and laws.
7. Other Rights Regarding Your Personal Data
In addition to requesting the deletion of personal information, you may have other privacy rights depending on the laws applicable to your situation.
In Mexico, where applicable, these may include the rights of Access, Rectification, Cancellation, and Opposition (ARCO rights).
You may also be entitled to withdraw consent or request limitations on certain processing activities when permitted by applicable law.
To learn more about the categories of data collected, purposes of processing, technology providers involved, and how to exercise your privacy rights, please review our complete Privacy Notice.
